The Constitutional Court (MK) has held a dispute session of the 2024 Regional Head Election (PHP Pilkada) for four regions in East Nusa Tenggara (NTT), namely the Alor Regency Election, Rote Ndao Regency, Sikka Regency, and Wednesday Raijua Regency.
Of the four sessions of the 2024 regional election dispute, the Constitutional Court judge rejected the PHP lawsuit of two applicants, namely for the Sikka Regent (Pilbup) and Sabu Raijua Pilbup 2024.
“For Alor Regency, the request was withdrawn and could not be submitted again. Rote Ndao Regency, the Constitutional Court was not authorized to prosecute and decide the case. Sikka Regency, the request was unacceptable. Sabu Raijua Regency, also the request was unacceptable,” said NTT Magdalena Bawaslu member Yuanita Wake in his statement via WhatsApp (WA), Tuesday (4/2/2025) night.
Yuanita emphasized that the interim decision of the Constitutional Court was the last decision on the dispute over the elections. He considered the decision of the Panel of MK Judges was in accordance with PHP arrangements, including in terms of time period and substance of the application at the Constitutional Court.
“In general, the Constitutional Court’s decision was the first and last decision. That is, the decision was final and binding,” Yuanita said.
After the Constitutional Court’s decision, he said, the General Election Commission (KPU) of the district level would hold a plenary for the determination of the elected regents and deputy regents for 2025-2030. After that, the local government (Pemdap) can only propose the inauguration of the elected regional head.
According to Yuanita, the Constitutional Court will still hold six sessions of the 2024 regional election dispute in NTT. The six PHP sessions of the 2024 Pilkada, namely for the Southwest Sumbawa Pilbup, West Sumba, Belu Regency, South Central Timor Regency (TTS), East Flores, and West Manggarai.
